The Leadership of the Economic Chamber of North-West Macedonia conducted a meeting with the Minister of Justice, Igor Filkov, in which the proposed amendments to the Law on Enforcement were discussed, with a special focus on Article 218.
The meeting was attended by Acting President Nuhi Aliu, Executive Director Durim Zeqiri, Honorary President Xhemail Dauti and Operational Manager Miranda Ajdini.
The main purpose of the meeting was to review the draft amendments published in ENER, which provide for the expansion of the protection of funds and assets of state institutions, local self-government units and public enterprises from enforcement procedures.
For many years now, the ECNWM has been raising the alarm about the problems that Article 218 causes in contractual relations between the private sector and public institutions, creating legal uncertainty and difficulties in the realization of companies’ requests.
In this regard, the ECNWM presented its concrete proposals, requesting the deletion of Article 218 to ensure equal treatment for all legal entities and increased legal certainty in business relations. At the same time, the importance of strengthening the transparency and accountability of public institutions was emphasized as key elements for a stable and reliable business climate.
The Executive Director, Mr. Durim Zeqiri, emphasized that private companies, in addition to other economic challenges, also face a lack of legal certainty in relation to public institutions, due to limitations in the enforcement mechanisms and legal protection offered to them.
The Minister of Justice, Mr. Igor Filkov, expressed readiness for cooperation and welcomed the proposals of the ECNWM, assessing them as reasonable and valuable for advancing legal solutions. He emphasized that the same will be reviewed within the framework of the working group for drafting the relevant law.
The ECNWM assesses as necessary the addressing and resolution of these issues in a systematic manner, emphasizing that a balanced approach that guarantees the protection of the public interest, but also institutional accountability and legal certainty for businesses, will contribute to the creation of a fairer and more functional environment for all parties.
